Terms of use for the Famili platform.

§ 1 Scope

Applicability of these terms.

These General Terms and Conditions (Terms) apply to the use of the Famili platform, consisting of the website and web app (hereinafter "Platform").

Operator: Oliver Pitsch, Gerhard-vom-Rath-Straße 63, 50968 Köln, Germany (hereinafter "Operator").

The platform is intended for persons of legal age. By registering, you accept these Terms. The information in the imprint and privacy policy applies additionally.

§ 2 Service description

What Famili offers.

Famili is a digital family organizer for jointly managing everyday family life. The platform offers the following features, among others:

Shared family calendar, task management, reminders and notifications, contact management, document storage with sharing, child profiles, and family workspace with role management.

Famili provides the technical infrastructure. Users are responsible for the content of the data they enter.

§ 3 Registration and user account

Access and account management.

Registration is required to use Famili. Authentication is handled by an external service (currently Clerk). You are obliged to provide truthful information and to keep your access credentials confidential.

Only one user account per person is permitted. Each user account is assigned to a family workspace. You must notify us immediately of any unauthorized use of your account.

You can delete your account at any time by contacting famili@pitsch.me. If you have an active subscription, it must be cancelled before account deletion. Amounts already paid for the current billing period are not refunded.

§ 4 Trial period and contract conclusion

Free trial and subscription start.

After registration, you receive a free 30-day trial with full functionality.

A paid contract is only concluded upon subscribing through the payment provider (currently Stripe). You will be transparently informed about the price, duration, and cancellation options before subscribing.

After the trial period expires without a subscription, functionality will be limited.

§ 5 Pricing and payment

Costs and billing.

Current prices are displayed transparently on the website and before contract conclusion. All prices include statutory VAT.

Payment is processed through the external payment provider Stripe. Monthly and annual billing cycles are available.

In the event of a failed payment, access to full functionality may be temporarily restricted.

§ 6 User obligations

Responsible use of the platform.

You agree to use the platform in accordance with applicable law and these Terms. In particular, the following are prohibited:

Providing false or misleading information; posting unlawful, offensive, or discriminatory content; technically manipulating or overloading the platform; using third-party access credentials without authorization; processing personal data of other users without their consent.

§ 7 User content and data

Responsibility for uploaded content.

You are responsible for all content you upload to the platform, including documents, contact data, and information about child profiles. You ensure that this content does not violate third-party rights.

The operator does not review the content of uploaded data. Famili is a private family workspace — uploaded content is not publicly accessible unless you actively share it via the sharing feature.

When you delete your account, your data will be deleted in accordance with statutory retention requirements.

§ 8 Data protection

Handling of personal data.

The protection of your personal data is important to us. Data processing is carried out exclusively in accordance with the GDPR and the German Federal Data Protection Act (BDSG).

The platform processes particularly sensitive data such as information about children and health details. This data is used exclusively for the functionality of the platform and is not shared with third parties.

§ 9 Limitation of liability

Limits of the operator's liability.

The operator is liable without limitation only for damages arising from injury to life, body, or health based on an intentional or negligent breach of duty, as well as for other damages in cases of intent or gross negligence.

In cases of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Essential contractual obligations are those whose fulfillment enables the proper performance of the contract.

The operator does not guarantee the accuracy, completeness, or timeliness of content uploaded by users. The operator is only liable for data loss to the extent that such loss could not have been prevented by reasonable data backup measures on the part of the user.

§ 10 Availability

Platform accessibility.

The operator strives to provide the platform without interruption. There is no entitlement to permanent availability.

The operator reserves the right to temporarily restrict or suspend platform operations for maintenance, updates, or technical issues.

§ 11 Contract duration and termination

Duration, cancellation, and account closure.

Subscriptions automatically renew for the respective billing period unless cancelled in time before expiry. Cancellation is possible at any time effective at the end of the current billing period via the payment provider's customer portal or by email to famili@pitsch.me.

The operator may temporarily suspend or permanently delete the user account in cases of serious violations of these Terms, unlawful conduct, or misuse of the platform. Before permanent suspension, a notification with the opportunity to respond will usually be provided.

After termination of the contractual relationship, data stored in the family workspace will be deleted after a transition period of 30 days, unless statutory retention obligations apply.

§ 12 Changes to Terms

Amendments to these conditions.

The operator reserves the right to amend these Terms with effect for the future. Significant changes will be communicated to you in advance (by email or notification on the platform).

If you do not object to the changes within four weeks of notification and continue to use the platform, the amended Terms are deemed accepted. You will be informed of your right to object and the consequences in the amendment notice.

§ 13 Dispute resolution

Online dispute resolution notice.

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

The operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final provisions

Applicable law and jurisdiction.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the user's country of residence remain unaffected.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected (severability clause).
